The Building and Construction Industry Improvement (Accreditation Scheme) Regulations 2005 established an appeals process for the Accreditation Scheme. If you are affected by a decision of the Federal Safety Commissioner (FSC), you may apply for a review of that decision.
Under the Regulations, the FSC can appoint someone not involved in the original decision to review a decision. That person will have any of the powers and functions of the FSC that are required to carry out the review.
On 9 April 2006 the FSC appointed the Deputy Secretary – Workplace Relations, of the Department of Employment and Workplace Relations, to undertake reviews of reviewable decisions.
